You are absolutely right that the false marking reform is a great change. Anyone that files such a claim false marking claims will be required to prove competitive injury and their damages will be limited to the injury. Additionally, the new law excludes marking with an expired patent. This part of the law is effective immediately and retroactively so that it applies to existing cases as well as future-filed cases.
